Draft terms · version 0.1, not yet reviewed by a lawyer

Who this is between

These terms are between Xavier Braithwaite, sole trader (ABN pending), who runs Goal Evidence Engine, and the organisation using it. “You” means that organisation. Anyone who signs in does so on your behalf and within the role you gave them.

What the service does

Goal Evidence Engine records what happened on a support shift and drafts a written report from it.

  • A support worker records their own notes, during the shift or straight after it.
  • The app drafts a report from those notes. Every sentence in a draft traces back to a note the worker wrote, checked character by character against it. A claim that check cannot match to a note is held out of the draft rather than printed with a caveat.
  • A person reads the draft and saves it in their own name. Nothing the model writes reaches a record on its own.

The app decides nothing about a participant, gives no clinical advice, and does not take over your record-keeping duties under the NDIS rules. It is the place the evidence is written down, not the person responsible for it.

Your records are yours

You decide what is recorded, who may see it and how long it is kept beyond the legal minimum. We hold those records for you and act on your instructions. We do not sell them, rent them, use them for advertising, or use them to train any model, ours or anyone else's.

Ask for an export of your data at any time and you will get one.

Using it properly

  • Use a first name or an alias for a participant. Never an NDIS number, a Medicare number, a surname, an address or a date of birth.
  • Upload a plan document for the goals in it. Do not upload one for anything else it happens to contain.
  • Do not scrape the app, drive it with automated requests, or try to reach another organisation's records.
  • Keep sign-ins to people you invited, and tell us when one of them leaves so their access can be ended.

We can suspend an account that breaks this. If we do, we will tell you which of these it was and what has to change.

The AI part, and what leaves Australia

The draft narrative is written by a model run by Anthropic, in the United States. That is the only place your content leaves Australia.

  • Phone numbers, email addresses and long identifying numbers are removed from the text before any of it is sent.
  • Anthropic is contractually barred from training on this content and deletes it within 30 days by default. Sessions their safety systems flag can be held for up to two years.
  • Using an alias reduces what is exposed. It does not make a shift note anonymous, and we do not claim it does.

The privacy policy sets this out in full, including what to tell a participant who asks.

Availability

There is no service level agreement in this version. We would rather say that than publish a number nobody measures. We keep the app running as well as we can, and when something is wrong or something is planned, we tell you by email.

Fees

There is no charge until a written order says otherwise. If one does, that order sets the price and these terms carry on around it.

Suspending and ending it

Either of us can end this with 30 days notice in writing. Ask for an export before the end and you will get one.

Ending it does not delete your records. The NDIS rules require care records to be kept for at least seven years, and for a participant record the clock runs from the end of the service rather than the day the note was written. That floor survives the end of this agreement. We keep the records for that period, we keep them reachable to you, and we deal with them after it as you direct.

What we are liable for

Our total liability to you, for everything arising out of these terms taken together, is capped at the fees you paid us in the 12 months before the claim. If you have paid us nothing, the cap is AUD 100. Neither of us is liable to the other for lost profits or lost business.

Nothing here limits rights under the Australian Consumer Law that cannot be limited.

Privacy

The privacy policy is part of these terms. It says what is collected, why, where it goes, how to get at it and how to complain.

Which law applies

These terms are governed by the law of Queensland, Australia, and the courts of Queensland deal with any dispute about them.

Changes to these terms

We tell you by email at least 30 days before a change takes effect, and the new version appears here with a new date. Carrying on using the app after that date means the new version applies.
